Terms of Use
Mustajer Platform and Application

Version 2.0 – Effective as of the publication date

Welcome to the “Mustajer” platform and application. These Terms constitute the legal framework governing the relationship between you (whether you are a visitor or a registered user, a lessor or a lessee) and Sabaaq Digital Solutions and Business, the owner and operator of the platform. Please read these Terms carefully before using the platform; your use of it constitutes your explicit agreement to be bound by all its provisions.

1) Introduction

1.1 These Terms govern your access to and use of the Mustajer website, application, and platform (hereinafter referred to as the “Platform”), which is a trade name and registered trademark of Sabaaq Digital Solutions and Business.

1.2 Please read these Terms together with the Privacy Policy and all supplementary policies (collectively referred to as the “Terms and Conditions”) to ensure full understanding before using the Platform.

1.3 By visiting, registering an account, browsing, or communicating with any party through the Platform, you acknowledge that you have read, understood, and agreed to these Terms.

1.4 If you do not agree to these Terms, you may not access or use the Platform in any manner.

1.5 These Terms are governed by the laws of the Sultanate of Oman, including but not limited to the Electronic Transactions Law, Commercial Law, Personal Data Protection Law (Royal Decree 6/2022), Cybercrime Law, and any related legislation.

2) Definitions

Unless the context requires otherwise, the following terms shall have the meanings assigned to them:

• Platform: The website, mobile applications (Android & iOS), dashboards, and affiliated channels of Mustajer.

• Company / We / Us: Sabaaq Digital Solutions and Business.

• User / You: Any person who registers or uses the Platform in any capacity, whether as a lessor or lessee.

• Lessor: Any individual or entity that registers an account to list items it owns or has the right to rent.

• Lessee: Any individual who registers and browses listings to contact lessors for rental purposes.

• Parties: The lessor and the lessee collectively.

• Items: Goods, assets, equipment, or objects offered for rent.

• Content: All materials published on the Platform including text, images, videos, audio, and graphics.

• Listing: A post created by a lessor describing the item, rental terms, and contact details.

• Package: A paid subscription that allows the lessor to publish a specified number of listings with added features.

• KYC: Know Your Customer verification procedures.

• Laws: Applicable laws in the Sultanate of Oman.

• Agreement / Terms and Conditions: These Terms along with the Privacy Policy and related policies.

3) Legal Scope of Services

3.1 The Platform acts solely as a technical intermediary connecting lessors and lessees. Its role is limited to providing listing, browsing, and communication tools.

3.2 Services include (but are not limited to):

• Account creation and subscription activation

• Publishing and displaying listings

• Search and filtering tools

• Communication channels between users

• Technical support

3.3 The Platform does not:

• Set rental prices

• Inspect or guarantee items

• Handle payments

• Manage delivery or returns

• Resolve disputes

All such matters are the sole responsibility of the contracting parties.

3.4 The Platform is not a party to any rental agreement and does not act as an agent or guarantor.

3.5 All rental agreements are negotiated and executed independently outside the Platform.

4) Electronic Contract

4.1 These Terms constitute a legally binding electronic contract under Omani law.

4.2 Clicking “Agree”, creating an account, or using the Platform constitutes a legally binding electronic signature.

4.3 The agreement becomes effective upon first use and cannot be disclaimed thereafter.

5) Eligibility and Use

By using the Platform, you represent that:

• You are at least 18 years old

• You have full legal capacity

• You comply with all laws

• Your information is accurate

• You are responsible for your actions

6) Account Registration

Users must:

• Provide accurate information

• Maintain confidentiality of login credentials

• Report unauthorized access

• Complete KYC when required

Restrictions:

• No multiple accounts

• No bypassing platform systems

• Violations may result in suspension or termination

7) License and Restrictions

7.1 You are granted a limited, non-exclusive, non-transferable license for personal use.

7.2 No ownership rights are granted.

7.3 Prohibited actions include:

• Reselling or exploiting services

• Reverse engineering

• Creating competing services

• Removing intellectual property notices

8) Prohibited Use

Users must not:

• Violate laws

• Impersonate others

• Post illegal or offensive content

• Use bots or scraping tools

• Upload malicious software

• Conduct fraud or illegal activities

Violations may lead to:

• Content removal

• Account suspension

• Legal action

9) Lessor Policy

Lessors must:

• Provide accurate listings

• Comply with laws

• Ensure item safety and legality

• Respond to inquiries

• Bear tax obligations

10) Lessee Policy

Lessees must:

• Provide accurate data

• Negotiate terms directly with lessors

• Act in good faith

11) Packages and Subscriptions

Includes:

• Free plan

• Boost plan

• Business plan

• Additional listings

All payments are non-refundable unless approved.

12) Payment Policy

• Platform handles only subscription payments

• Rental payments occur خارج المنصة

• Users must ensure payment accuracy

13) Rating Policy

• Users may rate each other

• Ratings must be fair and lawful

• Misuse is prohibited

14) Force Majeure

Neither party is liable for events beyond control such as:

• Natural disasters

• War

• System failures

15) Liability

• Use at your own risk

• Liability capped at OMR 200 or service value

16) Disclaimer

Services provided “as is” without warranties.
The Platform is not responsible for:

• Item quality

• Fraud

• Disputes

17) Indemnification

Users agree to indemnify the Company against claims arising from misuse.

18) Intellectual Property

All rights belong to the Company.
Unauthorized use is prohibited.

19) External Links

The Platform is not responsible for third-party content.

20) Electronic Communication

Users agree to receive electronic communications.

21) Termination

Accounts may be terminated for violations.
Certain obligations survive termination.

22) Amendments

Terms may be updated periodically. Continued use implies acceptance.

23) Data Protection

Users must protect others’ data.
Subject to Omani data protection law.

24) Governing Law

Governed by Omani law.
Jurisdiction lies with Omani courts.

25) General Provisions

• No partnership created

• Arabic version prevails

• Entire agreement clause applies
